Drug And Narcotic Sales Defense Attorney

What the prosecution asserts to be the sale of a controlled substance may, in fact, fall far short of the legal definition of that crime. At The Law Firm of Michael S. Berardino, formerly Mangialardi & Berardino in Hartsdale, New York, I am a former prosecutor who worked as Assistant District Attorneys in the Bronx County District Attorney’s Office. For the past 20 years I have been defending those who are accused of various crimes, such as drug and narcotics related offenses. I know how to effectively challenge the prosecution’s assertions.

I defend people charged with all types of all drug or narcotic sales, including, but not limited to:

  • Sale of marijuana, hashish, cocaine, heroin, pills, barbiturates, ecstasy, methamphetamines, or illegal prescription drugs
  • Possession of drugs with intent to distribute
  • Acting in concert with drug sales

In New York, you do not have to actually sell drugs to be charged with the crime of drug sales. In fact, if you give drugs to someone, you have sold them, or if you merely offer drugs to someone, you could potentially be charged with drug sales. Moreover, you could also face drug charges even if you view yourself as a minimal participant. For example, if you serve as a lookout or “steerer” for someone exchanging drugs, you could be charged with acting in concert with the sale of a narcotic.

The mere packaging of narcotics could expose you to being charged with possession with intent to sell, regardless of the weight of the drug, and this charge is a serious Class B felony.

In all cases involving a narcotic or controlled substance, the drug evidence and its discovery is often critical, as what may seem to be acceptable police behavior can actually be an illegal search. In fact, if the drug evidence is seized as the result of an illegal search, the evidence could be suppressed. As a skilled and knowledgeable drug crimes defense lawyer and former prosecutor, I have a thorough understanding of the laws of evidence as they relate to drug sales charges.

If you have been charged with sales of narcotics or a controlled substance in the New York City area, contact The Law Firm of Michael S. Berardino, formerly Mangialardi & Berardino, as soon as possible, locally at or 914-618-4167, or Toll Free at 877-776-5584. I believe in defending your rights and your freedom.
